I. DEFINITIONS

Whenever the following definitions are used in the following part of the Terms and Conditions, they should be understood in the meaning given below.

Terms and Conditions – these Terms and Conditions, together with appendices, informing about the obligations and rights of both Parties to the Agreement.

Civil Code – Act of 23 April 1964 (Journal of Laws 2020.1740).

Shop – online store available at: https://firanto.com/.

Client – a natural person, a legal person and an organisational unit without legal personality, which is granted legal capacity by law; purchasing products through the Firanto Online Store, available at www.firanto.pl.

Consumer – a natural person performing a legal act with an entrepreneur that is not directly related to his business or professional activity.

Buyer – Customer, Entrepreneur with consumer rights or Consumer.

User – any entity using the Online Store.

Party – the party to the Agreement is the Buyer or the Seller; in the case of the term "Parties" – the Buyer and the Seller jointly.

Entrepreneur with consumer rights – a natural person running a sole proprietorship, concluding an agreement directly related to his or her business activity, when it follows from the content of the Sales Agreement that it does not have a professional character for that person, resulting in particular from the subject of his or her business activity, reported on the basis of the provisions on the Central Register and Information on Economic Activity.

Service Provider/Seller – Firanto MB with its registered office at 89 Žeimenos Street, Kaunas, Lithuania, registration number: 305414905.

Sales Agreement – a contract for the sale of a Product concluded or concluded between the Client and the Seller through the Online Store. A Sales Agreement shall also be understood as a contract for the supply of digital content or a digital service (in the case of Products that are digital content or digital services) and a contract for the provision of services (in the case of a Product that is a service other than a digital service).

Act on Consumer Rights – Act of 30 May 2014 on Consumer Rights (Journal of Laws 2020.287).

Order – an offer to conclude a sales agreement submitted by the Buyer through the Firanto Online Store.

Product – any item sold through the Firanto Online Store.

II. GENERAL PROVISIONS

1. These Terms and Conditions for online purchases of Goods in the Firanto MB online store, registration number 305414905, registered office address: Žeimenos g. 89, Kaunas, Lithuania (hereinafter – the Seller), http://www.firanto.pl/ (hereinafter – the Online Store) (hereinafter – the Terms and Conditions) define the rights, obligations and responsibilities of the Seller and the Buyer.

2. These Terms and Conditions are drawn up in Polish and constitute a model agreement concluded at a distance, in accordance with the applicable provisions of law, based on the following regulations:

  • Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights,
  • Directive (EU) 2019/771 of the European Parliament and of the Council of 20 May 2019 on certain aspects concerning contracts for the sale of goods,
  • Directive (EU) 2019/770 of the European Parliament and of the Council of 20 May 2019 on certain aspects concerning contracts for the supply of digital content and digital services,
  • Act of 30 May 2014 on Consumer Rights (Journal of Laws 2020.287 as amended),
  • Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws of 2002 No. 144, item 1204, as amended),
  • The Act of 23 April 1964 Civil Code (Journal of Laws of 1964 No. 16, item 93, as amended).

3. These Terms and Conditions, with the consent of the Buyer (after reading the Terms and Conditions, placing an order and paying for the Goods), constitute a legally binding document for the parties, specify the rights and obligations of the Buyer and the Seller, the terms and conditions of purchase of the Goods and making payments, the rules of delivery and return of the Goods, the procedure, the liability of the parties and other provisions related to the purchase and sale of Goods in the firanto.pl online store.

4. To properly use the Store, the following are necessary: Internet access, an up-to-date web browser supporting JavaScript and cookies, and an active e-mail address.

5. The Terms and Conditions are available free of charge on the Shop's website in a way that allows them to be obtained, reproduced and recorded, including by downloading or printing.

6. By accepting these Terms and Conditions, the Buyer confirms that he has the right to purchase the Goods in the firanto.pl online store. Purchases are available only to persons with legal capacity.

III. PROCEDURE FOR CONCLUDING THE AGREEMENT

1. The purchase and sale agreement between the Buyer and the Seller shall be deemed to have been concluded at the moment when the Buyer – after selecting the Goods in the Online Store, adding them to the cart, providing the delivery address, choosing the payment method and reading these Terms and Conditions – confirms the placement of the Order.

2. All prices of the Products are given in Polish zlotys (PLN) and include VAT at the applicable rate. In the case of informing about a reduction in the price of the Product, the Seller shall also indicate the lowest price in force in the period of 30 days preceding the introduction of the reduction.

3. After placing the Order, the Client receives an automatic confirmation of its receipt by electronic means to the indicated e-mail address.

4. Each agreement concluded between the Buyer and the Seller is registered and stored in the database of the firanto.pl online store.

5. The Seller reserves the right to refuse to execute the Order in justified cases, in particular in the event of unavailability of the Product or an obvious price error. In the event of a refusal to execute, any payments made will be refunded immediately and the Client will be informed of the reason for the refusal.

IV. PERSONAL DATA PROTECTION

1. The Clients' personal data are processed in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and the applicable law.

2. The administrator of personal data is Firanto MB, 89 Žeimenos Street, Kaunas, Lithuania, registration number 305414905.

3. The online store firanto.pl use the data voluntarily provided by the Buyer. The Buyer's personal data is required only at the time of placing the Order and is used only for the purpose of concluding and performing the sales contract. The seller stores personal data for a maximum of 3 years.

4. The Seller may, in limited cases, share the Buyer's data with third parties only for the purpose of fulfilling the Order (e.g. courier companies), meeting the requirements of the law or preventing fraud. The seller does not collect or process sensitive data.

5. Clients have the right to access the content of their personal data, rectify them, delete them, limit processing, transfer data and object to their processing. The Client has the right to lodge a complaint with the supervisory authority – in Poland: the President of the Office for Personal Data Protection, https://uodo.gov.pl.

V. BUYER'S RIGHTS AND OBLIGATIONS

1. The Buyer has the right to purchase the Goods in the online store firanto.pl in accordance with the procedure specified in these Terms and Conditions.

2. The Buyer has the right to withdraw from the contract of purchase and sale of the Goods concluded with the online store firanto.pl by notifying the Seller within 14 days from the date of delivery or collection of the Goods. The notification must be sent by e-mail to info@firanto.pl and should include an indication of the returned Goods. The Seller undertakes to accept the Goods and return the money paid to the Buyer within 14 days from the date of receipt of the returned Product. The Buyer may exercise this right only if the Product has not been damaged or significantly altered visually and has not been used. All returned Goods must have the original labels and original packaging. The costs of returning the Goods are borne by the Buyer.

3. The Buyer has other rights provided for in these Terms and Conditions and in applicable legal acts, including the Act on Consumer Rights of 30 May 2014.

4. The Buyer is obliged to pay the price of the Goods and delivery costs, as well as other fees (if specified in the contract) and to collect the ordered Goods.

5. The Registered Buyer may not pass on his/her login data to third parties. In the event of loss of login data, the Buyer shall immediately notify the Seller thereof.

6. If any data provided in the registration form changes, the Buyer is obliged to update it immediately.

7. By using the firanto.pl online store, the Buyer is obliged to comply with these Terms and Conditions and not to violate the applicable provisions of law.

VI. RIGHTS AND OBLIGATIONS OF THE SELLER

1. The Seller undertakes to deliver the Goods in accordance with the Sales Agreement within the agreed deadline.

2. The Seller shall be liable for the lack of conformity of the Goods with the contract existing at the time of its delivery and disclosed within 2 years from the date of delivery.

3. The Seller reserves the right to refuse to execute the Order in justified cases, informing the Buyer about it and returning any funds paid.

4. The Seller ensures that the Products offered in the Store meet the requirements of the applicable provisions of European Union law and Polish law regarding product safety, including Regulation (EU) 2023/988 on General Product Safety (GPSR).

VII. PROCEDURE AND TERMS OF PAYMENT FOR GOODS

1. The following payment methods are available in the Store: online banking, BLIK, payment card, PayPal.

2. Electronic payments are made through external payment service providers: Przelewy24 and PayPal. The Seller does not store the Customers' payment card details.

3. With the consent of the Seller, the Buyer may also use other payment methods.

4. If you choose to pay online, the Order is handed over for processing after confirming the receipt of the receivables. In any case, the completion of the shipment and the delivery of the Goods begin only after receipt of payment for the Goods.

VIII. DELIVERY OF GOODS

  • Delivery of Orders is carried out in the following territories: European Union countries, Switzerland, Norway, Iceland, Liechtenstein, Andorra, Monaco, San Marino, Vatican City, Ukraine,
  • United States, Australia, New Zealand.

2. Available delivery methods, their costs and approximate delivery dates are indicated in the Store at the stage of placing an Order and include:

  • InPost express delivery 3-5 days
  • InPost delivery to a parcel locker 2 days

3. The goods are delivered by the Seller or its authorized representative. As a general rule, the Goods are delivered within 2-3 working days of receipt of payment.

4. The Buyer collects the Goods in person. If the Buyer is unable to collect the Goods in person and the Goods are delivered to the indicated address on the basis of other data provided by the Buyer, the Buyer is not entitled to make claims to the Seller for the delivery of the Goods to the wrong person.

5. At the time of delivery of the shipment, the Buyer or his representative must check the condition of the packaging and the quantity, quality and assortment of Goods. In the event of damage or non-compliance, the Buyer should not accept the shipment and should draw up a damage report together with a representative of the transport company.

6. After receiving the shipment and signing the confirmation of receipt without reservation, it is considered that the Goods have been delivered in an undamaged condition and fully comply with the terms of the purchase and sale agreement.

7. If the Goods are not delivered on the planned delivery date, the Buyer is obliged to notify the Seller immediately, no later than the next day after the planned delivery date.

8. The risk of loss or damage to the Product passes to the Client at the moment of physical release of the Product.

IX. COMPLAINTS AND WARRANTY

1. The Seller shall be liable for the lack of conformity of the Product with the contract existing at the time of its delivery and disclosed within 2 years from the date of delivery.

2. In the event of non-compliance of the Product with the contract, the Client is entitled to demand:

  • repair or replacement of the Product – as the basic means of bringing the Product into conformity with the contract,
  • price reduction – if repair or replacement is impossible, requires excessive costs, has been refused or has not been carried out within a reasonable time,
  • withdrawal from the contract – in the event that the Product has already been replaced or repaired by the Seller, or if the Seller has refused to bring the Product into conformity with the contract. The buyer cannot withdraw from the contract if the non-conformity is insignificant.

3. If the lack of conformity of the Product with the contract becomes apparent before the expiry of 1 year from the date of delivery, it is presumed that it existed at the time of delivery. The burden of proof then rests with the Seller.

4. Complaints can be submitted:

  • Electronically to the e-mail address: info@firanto.pl
  • In writing to the address: 89 Žeimenos Street, Kaunas, Lithuania

5. The complaint should include: the Order number, a description of the non-conformity found, photographic documentation (if possible) and an indication of the desired method of bringing the Product into conformity with the contract.

6. The Seller shall respond to the complaint within 14 calendar days from the date of its receipt. Failure to respond within the above deadline means that the complaint is accepted.

7. The Client is obliged to deliver the advertised Product at their own expense. In the event of a positive consideration of the complaint, the Client will receive a refund of the intended costs of delivering the Products.

X. LIABILITY

1. The buyer bears full responsibility for the correctness of his/her personal data and for the consequences of any misrepresentation or inaccuracies in the data provided.

2. For any breach of the purchase and sale agreement concluded through the online store, the Buyer and the Seller shall be liable firanto.pl accordance with the applicable provisions of law.

3. Each registered Buyer is responsible for providing their login details to third parties. If the services of the store are firanto.pl used by a third party who has logged in with the Buyer's data, the Seller considers this person to be the Buyer.

4. If the Online Store contains links to the websites of other companies, institutions, organizations or individuals, the Seller is not responsible for the information contained therein or for the actions taken therein.

5. The Seller shall not be liable for situations in which the Goods presented in the Store do not correspond to the actual Goods in terms of size, shape or color due to the properties of the monitor used by the Buyer.

6. The Seller shall not be liable for delays or non-performance of obligations caused by circumstances beyond its reasonable control, including force majeure or the provision of incorrect data by the Client.

XI. NOTICES

1. The Seller sends all notifications to the e-mail address provided by the Buyer.

2. The Buyer sends all notifications and inquiries using the means of communication indicated on the website of the Seller's online store firanto.pl.

XII. OUT-OF-COURT DISPUTE RESOLUTION

The consumer has the opportunity to use out-of-court, voluntary and free methods of resolving disputes, in particular by:

  • the district or municipal consumer ombudsman,
  • Permanent Consumer Arbitration Court at the Voivodeship Trade Inspection Inspectorate,
  • Voivodeship Trade Inspection Inspectorate,
  • European Consumer Centre in Poland – in cross-border cases.

XIII. FINAL PROVISIONS

1. These Terms and Conditions are drawn up in Polish and are subject to the provisions of Polish and EU law. In unregulated matters, the relevant provisions of the Civil Code and the Act of 30 May 2014 on consumer rights apply.

2. Any disputes arising from the implementation of these Terms and Conditions shall be resolved through negotiations. In the event of disagreement, disputes will be resolved by the competent common court.

3. The Seller reserves the right to make changes to these Terms and Conditions for important reasons. Any changes shall enter into force no less than 14 days after their announcement on the Store's website.

4. In accordance with Article 8(3)(2)(b) of the Act of 18 July 2002 on the provision of services by electronic means, the entity using the Store is obliged not to post illegal content.

6. The Terms and Conditions enter into force on 1 January 2026.
